In response to the bipartisan Senate 340B “Gang of Six” working group’s introduction of the SUSTAIN 340B Act on August 5, 2026, Advocates for Community Health (ACH) issued the following statement:
“ACH is grateful to Sens. Baldwin (D-WI), Boozman (R-AR), Capito (R-WV), Hickenlooper (D-CO), Kaine (D-VA), and Moran (R-KS) for their leadership to craft comprehensive legislation to preserve health center access to 340B savings.
Bipartisan legislation to bring greater clarity, transparency, and accountability to the 340B Drug Pricing Program while protecting its fundamental purpose—expanding access to care for patients and communities that need it most— is desperately needed, especially in light of the Administration’s announcement to move forward with the misguided 340B rebate model proposal.
The framework builds upon a previously released draft of the SUSTAIN 340B Act and addresses contract pharmacy restrictions, patient eligibility, federal oversight, referrals, and program transparency. ACH has supported several key elements of the draft legislation, including recognition of the essential role contract pharmacies play in patient access; clearer expectations for program participation and oversight; transparency measures that protect patient care and health center operations; and the preservation of predictable, upfront discounts rather than harmful rebate-based approaches.
ACH and our community health center members have provided extensive input throughout this process to ensure policymakers understand how the program operates in real-world settings and how proposed changes could affect patients.
Community health centers account for less than 6% of all 340B purchases, yet the savings they generate are indispensable. Health centers reinvest those savings directly into keeping clinics open, lowering medication costs, and expanding behavioral health, dental, telehealth, and mobile services in rural and underserved communities.
As these discussions move forward, ACH will continue championing policies that protect patient access, preserve the original intent of 340B, and ensure reforms strengthen, rather than weaken, the program and the communities it serves.”
